1. The Air Waybill (AWB)
The Jabal Cargo air waybill is non‑negotiable. It is deemed to have been prepared either by the Shipper or by Jabal Cargo acting on the Shipper’s instructions.
Jabal Cargo’s responsibility for a Shipment ends once the Consignee signs the AWB copy on delivery.
All Shipments moved under a Jabal Cargo AWB travel strictly at the owner’s risk.
2. Shipper’s Obligations & Acknowledgements
Tendering a consignment to Jabal Cargo constitutes the Shipper’s acceptance of these Terms & Conditions.
The Shipper warrants that they are the owner (or authorised agent) of the goods and accept these Terms on behalf of every party with an interest in the Shipment.
The Shipper warrants that every article is accurately described on the AWB, complies with the Indian Post Office Act and all other applicable laws, and is not listed as “Unacceptable for Carriage” in Section 14. Each item must be correctly packed, marked, and addressed for safe handling.
The Shipper is solely liable for all costs, duties, taxes, octroi and charges arising out of transport, return, warehousing or disposal of the Shipment.
Carriage is undertaken only from the point of origin to the delivery address shown on the AWB. Any rerouting, redirection or return (including octroi, taxes and other charges) must be prepaid by the Shipper. Shipments unclaimed after 7 days may be destroyed without notice; the Shipper indemnifies Jabal Cargo against all resulting claims.
Proper and secure packing—including correct placement of goods inside any Jabal Cargo packaging—is the Shipper’s responsibility.
3. Jabal Cargo’s Right of Inspection
Jabal Cargo may, at its sole discretion, open and/or inspect any Shipment without prior notice.
Jabal Cargo reserves the right to refuse carriage of any item that breaches these Terms or applicable laws.
4. Insurance
Jabal Cargo does not provide automatic insurance. The Shipper may arrange insurance for the Shipment at their own expense.
5. Octroi, Customs & Other Duties
All octroi, sales tax, customs duty or similar charges are payable by the Consignee upon delivery. Jabal Cargo retains a lien on the Shipment until such dues and all freight and ancillary charges are settled in full.
6. Chargeable Weight
Charges are based on the chargeable weight:
The higher of actual gross weight (rounded up to the next 0.5 kg or 1 kg, per rate slab) or volumetric weight.
Volumetric weight (kg) = L x W x H (cm) ÷ 5000.
7. Lien on Goods
Jabal Cargo holds a general lien over all goods in its possession for unpaid freight, duties, taxes, advances or other charges and may refuse delivery until all are paid.
8. Limitation of Liability
For loss, damage or delay (subject to Sections 9 & 10), Jabal Cargo’s maximum liability per AWB is the lesser of:
INR 1,000;
The actual amount of loss or damage proved; or
The declared value of the Shipment, assessed without reference to special or consequential loss.
For personal, old or used items, the Declared Value is capped in line with Indian Customs limits. For commercial Shipments, the invoice value declared by the Shipper applies, up to the INR 1,000 overall cap.
9. Exclusion of Consequential Damages
Jabal Cargo shall in no circumstance be liable for indirect, incidental, special or consequential damages, including (but not limited to) loss of profit, income, interest, market or utility—whether or not Jabal Cargo had notice of the possibility of such loss.
10. Liabilities Not Assumed
Jabal Cargo is not liable for loss, damage or delay arising from, among other causes:
Acts of God, force majeure, riots, strikes, civil commotion, political disturbance, war, aircraft delays, vehicle fire or explosion, or any event beyond Jabal Cargo’s reasonable control.
Acts, omissions or fault of the Shipper, Consignee or any third party with an interest in the Shipment.
Actions of carriers (e.g., airlines) or government officials (Customs, taxation, octroi, etc.).
Inherent defects or the nature of the goods, electrical or magnetic injury, deletion or erasure of data, photographs or recordings.
The Shipper shall indemnify Jabal Cargo against claims, penalties or expenses arising from regulatory inspections or violations.
11. Return-to-Origin (RTO), Refunds & Dues
The Shipper is liable for all clearance charges, import duties, warehouse fees and DDP costs if the Consignee refuses to pay.
If destination Customs reject the Shipment under local law, Jabal Cargo cannot guarantee RTO.
Non‑delivered Shipments may be returned to origin or destroyed without notice; return freight and associated dues are chargeable to the Shipper.
Refunds for cancellation are processed only after the Shipment returns to origin.
Detailed RTO fees (pickup, AWB cancellation, warehousing, labour, etc.) are set out in the Shipment Return Policy below; all such charges plus GST are payable by the Shipper.
12. Inspection by Authorities
Regulatory bodies (origin or destination) may open packages for physical inspection. Jabal Cargo accepts no responsibility for repacking issues or box-count discrepancies arising therefrom. Prohibited or restricted items sent knowingly or unknowingly remain the Shipper’s sole liability.
13. Claims Procedure
Written claims must reach the nearest Jabal Cargo office within 15 days of Shipment acceptance. Claims filed after this period are barred.
Freight and ancillary charges must be paid in full before a claim is processed; they cannot be deducted from any claim amount.
Partial-loss (short-delivery) claims are not entertained; only claims for total loss of the entire consignment are considered, with a cap of INR 24,999 or the declared invoice value—whichever is lower.
14. Materials Not Accepted for Carriage
Jabal Cargo does not carry items prohibited by law or IATA regulations, including—but not limited to—currency, bearer instruments, blank share‑transfer forms, hazardous chemicals, live animals, narcotics, firearms and any article infringing the Indian Post Office Act. A detailed list is available on request.
